Hi Sandra, no-one in the HRA has yet issued law suites against El Riad, this could be something on the horizon but they are listening to the solicitors and it's not DWS anymore.

Hi Sandra, what Dentons and the HRA members are doing is discussed in the their members area and will be kept there. I believe you are concerned with Lotus Breeze which is a separate issue and one which I have pointed out is being handled by Michael Joseph, have you instructed him yet? He is dealing directly with Samy Omar for all those that have instructed him and will be sorting out their issues.

I have just returned from Egypt (last night), and I have something to say that you should all hear. I met with Michael Jospeh and jumped through all the hoops necessary to give him POA, which involved going to the passport office to have it stamped, then to an official translator to have the agreement legally explained, and then to meet MJ, and all whilst suffering from Pharoah's Revenge! Now that I have done this, and so has one other person, YOU DO NOT NEED TO! All you need to do is sign up to the class action, and pay your fee! You don't need to go to the embassy in London to give your POA.

He only needed one POA to proceed, but so far only 10 have paid the fees which were negotiated for a group.

He has met with Samy Omar and has seen no evidence that he is crooked, but is just acting for Yasser who is telling him certain apartments without sales contracts. He told him about mine and Omar asked to see proof that I have a contract. I took this to mean he was under the impression it was not already sold.

He thinks a large (as many of the 200 as poss) class action is the way to go, and he can then petition the government to assign a task force to oversee the completion of the block, with the essential security in place. Not quite sure how this works while Mo is only available by phone, but I have to trust his judgement.

I have had one or two questions about what MJ has done so far.

It is not the case that MJ has done nothing. He has had several meetings with Omar, and I am sure this must have already slowed the double selling, but he wants to do this the right way, and the only certain way to get the apartments finished. This requires a large enough class action to make the authorities listen, and fear the bad press Hurghada would get otherwise, and assign a task force to oversee the build. He really believes he can achieve this.

There is still a stupid 'possession is 9/10 of the law' law in Egypt, so just getting the apartments back isn't going to get them finished, or prevent this all happening again. We need it done with the correct security in place.

As for getting our money back instead, forget it. Although Yasser and Mo both have money, it will be so well hidden, it's not worth trying.

The 200 figure I used to describe the potential number of owners is plucked out of the air. The point is, we need as many as poss to make this strategy work. We do also need to remember that the £200 was negotiated based on at least 20 people doing it. So far there is only 10.

This is how I see things, based on my conversations with MJ. What's the point of just getting an unfinished shell back, with no prospect of getting it finished, and no security to stop someone else stealing it?

It would still be Mo's money, but the gov task force would oversee it, and install security. Although Mo is currently only available by phone, and through lawyers, MJ says this would change if the gov were involved. They could find him if they wanted to, and he knows it.

Time is ticking, and unless more join in this class action very soon, I for one will be asking MJ to take an alternative tack (and will gladly pay more fees), and work to help those that have paid get something back for their money, whether it be property, land or anything else that can be sold, and let LB sink into the abyss with all the rest on board. If any of you are thinking our efforts will result in your property being saved along the way, without your action or money being contributed, think again. I'm disgusted with the lack of response to this. Perhaps you are all rich, and can afford to lose this money. I am not. It is Sunday morning now and I am at work, where I always am. I work bloody hard, and thought I could buy a little piece of sunshine. I will not lose it without a fight.

Haven't heard anything from MJ, other than that he was ill a few days ago when I messaged him. Anyone else heard anything? The other forum says work is (maybe) starting again, and something about a meeting of owners with Samy Omar?

I had some photos sent to me over the weekend and it doesn't look as though much is happening, I was told some workers could be heard inside but that's it, although there are rumors going round that a deal has been done with the owner of RAJAC School to take it over and finish it, which is what happened with the other El Riad project in El Kawser behind Metro. I don't know who this is or if it is true but I have asked some people to ask around for me, you are right MJ has been ill but I have told him he needs to email you all.

There has been some very inaccurate and miss leading emails being sent out to Lotus Breeze investors and posted on various forums and Facebook pages. Action is going to be taken against the individuals and I have been asked to post this letter to set the records straight and tell the facts not lies, it will also be emailed to all concerned.

I spoke to Michael Joseph last night and he has told me his team are still working on Lotus Breeze for those that have instructed him, he hasn't emailed anything out as it all needs to be kept confidential.

If you own an apartment on Lotus Breeze, you should have received this email today if not please read:

Dear All,

I hope you are all well? Hopefully, you will all have heard the good news that many others have now been arrested in Hurghada, these people have been responsible for the double/triple selling of your apartments.

If you haven't already given a Power of Attorney to a solicitor in Hurgahda, NOW is the time to fly out there and fight for your apartment, you will not have a better time than now to get your apartment back. Others can only do so much for you, if you want what you have paid for, book a flight and get out to Hurghada ASAP, meet with Remon Nazih (senior attorney for Blue Systems) or your own solicitor and go to the police station and prosecutors office.

If you have given a POA, then instruct your lawyer to file the complaints on your behalf and make sure these crooks don't get out and flee like Yasser Ibrahim.

If you don't take action now, you will not have another chance like this, please do not pass this opportunity up, if you can't get to Egypt, then look into arranging a POA through the Egyptian Embassy in your own country. For those in the UK, I can give some guidance and I think it costs around £200 (but not sure), maybe a short flight to Egypt would be better, I think you can get flights that do Tues-Fri or Fri-Tues.

I am going to be out there 6th-13th December if you can get out while I am there I will assist you as much as possible

If you fail to act now, there is no one else to blame, the crooks have been caught for you and now in the right place for you to attack, so attack hard and fast.

I also spoke to Mohamed this morning and he said work has been going on, on Lotus Breeze I haven't had this verified yet, but will try to go and have a look myself when I go out.

If you go out and have the correct paperwork the solicitor may be able to go to the police station to file a complaint and then go and break the door in on your apartment and replace with your own door/lock then security will need to be sourced, but if there are enough of you it should be ok.

I have just had this update from Mr Remon Nazih, Senior Attorney for Blue Systems Ltd

Samy Omar got 4 days in the jail for under investigation, Today the judge will see his case for renew the investigation maybe he will get more 4days maybe he not.

When I know any information, I will inform you.

Hi Mr Hollingworth and all,
My name is Robert Dawson. We spoke briefly on the phone the other night. I was wondering if you wouldn't mind giving me some advice. I bought an apartment in Lotus Breeze through Uncover Egypt in Jul 2008. I paid el riad 25,000 (70%) up front. My egyptian solicitor is Mr Khalid El Nouby. Has anyone any experience of him? I have been advised by him to meet him in hurghada and file a theft at the local police station. Is this the correct procedure and is there another way to do this. i.e. A group that you know of that I could join to file a joint complaint or through the egyptian embassy?
To my shame and due to unforeseen commitments, I have not been able to prioritise this as I should have, but I'm in a position now to fight for my money, if it's not too late.
